Hi, if my daughter claims for Incapacity benefit is she still able to work? Thank you

To get Incapacity Benefit you need to show that you can't work. If the benefit was paid for mental health reasons she might be allowed some voluntary hours if they were considered 'theraputic'.

What it is, she has Behcets disease an autoimmune disease which makes her bedbound when she re-lapses, when she is in remission she is fine and can work, but when she does re-lapse she cant get out of bed and needs my care to help shower, get her to the loo, make her dinner and look after her little girl, so she is unable to work then. Would she be entitled to the benefit?

would probably be more appropriate to apply for disability living allowance - and you can get that if you work or not and is not means tested...x

Her consultant will write letters of support if necessary and they agree.

Do you really think she would be entitled to DLA then, i wasnt to sure about this, eventhough there coming down hard on the ones that are claiming it? I really do hope so as she needs it so much. Thank you for you responses.x

If she does find she is entitled to it, how would they pay her, as ive said previous although its a life time disease it does go into remission, so they wont pay her will they if its in remission, only when she re-lapses? How would that work then? x

You really need CAB help on this, they will tell you everything you need to know, while people on here are more than helpful, you could well get the advice, this subject is very intricate, we have just been going through similar problems in our household. Believe this or believe this not:
one of the questions they asked is: how long does the applicant spend sat on the toilet each time?

lol yes i know i have read the application form, its just ridiculous, i think the main objective is with these forms they are hoping you will get dso frustrated with filling in the answers that are required that you will give up, but we cant give up, there is so many people out there that just dont need the bedefit, and then theres the ones that are honest are need as much help as thy can possibly get. They dont back pay by any chance do they, as my daughter had this 5 years ago and its taken this long to diagnose as its such a rare disease? x

if you can get help filling out the form, maybe ask at the doctors. filling out the forms properly is important, dont be vague or downplay the problems, one day she may have a very bad time that you have not allowed for.
