hi please could you help me my dear mum passed away 3 months ago and as far as i no she never left a will so my brother and i will share her house my mums wishes were that my brother lives there when she dies as he as never married and lived there all his life i would want to respect her wishes for him to live there.
she only had her house to leave as my brother has half her left over money from her pensions after the bills were paid saved up in his savings accounts and the other half he has spent on vintage items on ebay all this totals up to around 40k can i do anythink about this please as i feel that if mums money was in her account we would both have a share of it.thanks

he can afford it i only want about a quarter of the houses value but he wont agree to give me it.
That is a very generous offer. In that case I feel you would be morally entitled to disregard your mother's wishes and sell.
I think you will find that without a will from your mum, he has to split all the assets equally between you. He sounds like he's hanging in there for all he can get which is not fair to you. Get on the phone to the CAB - you need to find out your entitlements and get someone to act for you. A letter from a solicitor is likely to have far more effect that you just talking to him about it. Get what you deserve, your mum might have wanted him to stay in the house but not for you to end up with hardly anything out of it. Please phone them and go and see them - we can't do anything, you need to put this on a legal footing without any more delay.

Yes I did about the sister but has anybody actually looked at all her previous posts? I think it's odd but as I'm seemingly alone in this I must be wrong.
And on a sentimental point the first answer she got on 27 Mar 07 about a will was from Ethel.
