dad killed by car pedestrian
my dad was killed in jan 2010 and im still waiting on the crown charging this woman ,do they realise what me and my family are going thru i got .I got letter yesterday threatning me with court due to dads funeral bill . sickening

Sorry for your loss, Harv..........threatening letters can be very worrying and understand your concern.
Firstly what arrangement was made to cover costs of your dad's funeral and were you given time to pay it and did'nt?
Can you make an arrangement with Funeral company to pay in installments so not to proceed with the court action?
Do you have anyone/family/friends that can assist you with payment now, so as to avoid court action?
Get some help by contacting CAB and asking for advice in this matter. If matter does go to court you may be eligle for legal aid.
I hope you get this matter sorted out soon, and once again, i'm sorry for your loss.

As already said, you do need to come to an arrangement with the funeral directors, regardless of whos fault the accident was.
I doubt your dad would want you to have a court judgement hanging over you. Did he leave any money to cover his funeral expenses? did he have life insurance? you need to sort the finances out regardless of what is happening with the criminal case, you say they havnt even charged her, they may never do

I am very sorry for your loss, but, don't bank on any money being awarded to you. Even if she's found guilty as charged, she may get a ban/and a fine for dangerous driving or driving without due care and attention, and you may be awarded 'costs' that is the cost of it going to court, but it doesn't necessarily mean you'll get the cost of the funeral covered. As somebody else on here suggested, go to the citizens advice bureau (look them up in the phone book) I hope everything turns out good for you
Never mind the Crown Court case, there must have been an inquest. Whilst the point of an inquest is not to attribute blame, can you recall what the coroner said?
Your claim is under the Fatal Accidents Act and you do not have to wait for the Crown Court case at all. The burden of proof is different in civil which is the balance of probabilities. The burden of proof in the Crown Court (criminal) is beyond reasonable doubt. Thus it is possible for the defendant to be acquitted at Crown Court but still found guilty of negligence. I would suggest you seek legal advice. Indeed, your claim will be against the driver's insurance company - assuming she had one. IF she is sent to prison after the Crown Court case, getting any money out of her will be nigh on impossible.
I would be inclined to write to the funeral directors and explain the situation.
Then contact a firm specialising in Fatal Accidents for advice - often they do a half hour free interview.
Also did your father have any other assets? Did he leave a will? Has probate been granted yet?

obviously, I am sorry about your dad, that's shocking. the bill still needs to be paid. if you're on benefits you may be entitled to a funeral grant via the Social Fund at the Jobcentre. if I were you, I would pay the bill (if you can) and keep all the receipts, then see if you can claim them back from the other party.
you could get yourself into trouble if you don't pay the bill. best of luck.
