Does anyone know the answer to this please. If you get made compulsory redundant and you have annual leave due to you after your leaving date, do you have to take that annual leave earlier whilst you are still in the job or do they have to pay you the extra money. If so, is this a legal thing or entirely up to the company you work for.
If they have given you a date for redundancy and you have no holiday planned, they cannot force you to take that holiday and have to pay you in lieu of holiday. This will usually be paid as part of your final leaving package.
I have booked two weeks in August, but if I get made redundant then the job goes at end of July, I was wondering whether to take the two weeks earlier, dont want to work it if they dont pay me.
the way we work it here, say for example you holiday year runs jan to dec and you are made redundant wef 01/05/10 you would be paid any holiday owing to you upto 01/05/10. if you have holiday booked in august you wouldn't get paid for it as you are no longer employed at that date
