What do I do if I have paid for an item, and the seller is convinced he/she sent it ages ago to your address? What right does the buyer and seller have here?

If the seller does not deny that you have paid for it and she/he has posted it in good faith then, unfortunately you're on a hiding to nothing by persuing the seller.

Your only hope is to ask the seller to seek compensation from the carrier.  Royal mail will refund lost items, no questions asked, up to (I think) 25.00.  Other carriers, eg. DHL, have their own compensation rules but more often than not the shipper has to take out insurance.  Again you'll have to get your seller to investigate.

For the future, always get your seller to obtain proof of postage (If by Royal mail) if by another carrier then the carrier signs for it when collected but the shipper still needs to specify insurance value.

Good luck

Click on the link below, you can report to eBay here that you have not received the item, and they in turn will put a bit of pressure on the seller to rectify the stuation. Incidentally, if you paid by Paypal, i think you are covered up to about 500? for missing items.

Check back on the sale on ebay and see if she said she would use recorded delivery or similar in her description.  A good ebayer would never send anything without proof of posting or recording the posting.

Check out her comments and see if anyone else as complained in the past and contact them and see if it was ever resolved.

the seller does not need to investigate with the royal mail YOU are perfectly entitled to do so also and seek compensation from royal mail - i know i have done it (but not in ebay situation)
Same thing happened to me but as a seller- I had proof of posting & filed a complaint with Royal Mail. After some time- they compensated the buyer (the purchase price + extra for "inconvenience". The parcel never appeared. On the other side of the coin- another parcel went missing & after I once again, chased up Royal Mail- the buyers parcel suddenly mysteriously appeared the very next day (along with several others she hadn't received! Johntheplamf is 100% correct- file an non receipt of item with eBay & they will chase up the seller. Same with PayPal although, they take an awful lot longer, to sort things out.
