Is their a defence for not having car tax?

No THERE isn't, not if you've got a car and drive it on the road.

yes, the car was made 50 years ago and you don't need a road fund licence for it
Historically exempted vehicles do require a road fund licence, the difference being it is nil rated.

The only defence for no tax is SORN.
Not having a car?
Change of ownership & requiring MOT.
tamborine is right - but if you are driving to a MOT centre for a test, and you have no road tax, the test must be pre booked. And you must have insurance.
What about driving home from the MOT test?
Tell the court that your name is Richard Cranium,that should get their attention! LOL
