Hi,

My brother and his wife are looking at getting charged with GBH s.18 , the man involved was threatning and said he would rape my brothers wife if he ever catches her alone and when my brother found out he said this he lost it and went to his house broke in and smahed few stuff on him, now the man is pressing charges and my bro and his wife have been told they will be charged with gbh s.18
attending court later today...

its there 1st offence ever , however the man that is pressing charges has atleast 7 conviction before

what should they be expecting?
and if both are charged what will happen to their kids?

Why would the wife be charged? Did she go round with him?
if they assaulted him, they will be charged and sentenced accordingly. the law takes a dim view of people who take justice into their own hands - it won't matter about the blokes previous if your brother went there with the sole intention of assaulting him either. why would they want anything to do with a low life scum like this anyway? is always better to turn the other cheek...if they are both sentenced to prison (intent and the severity of injury) , i think its obvious what will happen to the kids, but you will all just have to wait and see what the courts decide - it is pointless speculating

The starting point at crown court if found guilty by a jury is 8 years to life.
They could be offered a plea bargain at court by the prosecution, though they don't have to offer one.
My best advice would be to get a good barrister, however this doesn't always matter as there doesn't seem to be set sentences with any court for any crime.
The fact that he broke into this mans house would normally count as aggravated burglary which carries a sentence of up to 5 years.
Did your brothers wife enter the property?
As was previously said the 'victims' criminal record would only come into it if there was blame on both sides, which by the sounds of it there wasn't.
Your brothers defence is hearsay and hard to prove.
They will probably offer him a plea bargain in return for his wife getting off or receiving a lesser sentence.
As i said it sounds like he needs a good barrister!

oki they attended court today , and got bail on the grounds that they dont contact the "victim"

the house my brother kicked the door in too belongs to the girl friend of the "victim" who is also quite a close friend to my sister in law, the girl friend has pressed charges against the "victim" of blackmail and him trying to sell her for sex to other people he has also made videos of her while having sexuel intercourse without her knowledge
the girlfriend was also there at the time of the incedent she made a statement at the time of the incedent which she later withdraw as she felt she was threatned in his pressence and made a new statement few days ago

this guy is one sick basterd, i dont expect you to belive me ( Tetjam) becouse i have no reason to lie here, im only here for some info and what they could be expecting
