Spoke to a guy and he says his estranged wife got his sons passport in her remarried name , but he never knew anything about it.
I was surprised i didnt think you could do that as he was 14 when it was done i thought hed have had to be asked /told ?

If the name is different from the birth certificate is it legal as hes been using the remarried name about 8 years ?

I dont know the legalities of advising the parent of a name change. But I do know that you can have a passport different to your birth certificate providing you can show evidence of who you were and who you now are.

As you know I changed my first name by deed poll and should I ever get round to renewing my passport I'll need to show the passport office my deed poll certification.
