You can sue anyone for anything you like whether you will win, is another matter.

If the impact was such that you could reasonably have expected the airbags to deploy, and occupants of the vehicle suffered injury as a result, you might have a valid claim.

To stand a chance of success, you would need expert witness evidence substantiating this bear in mind that the manufacturer might have a get out if the vehicle had not been subject to the relevant recommended service schedule.

If you or other vehicle occupants suffered injury as a result of the accident, I would recommend you contact a legal advisor for advice on the options open to you.
The airbag would not be expected to deploy in a side impact
Ive always wondered what the purpose of side impact airbags is now I know.
The title of the question is airbag failed to deploy - singular
Rewind to the beginning.

Can we have more clarification on the accident and the airbag(s) please mcamacho?
has it side airbags?...front airbags need frontal impact within certain degree,s off centre and the speed of the impact is taken into account , which seems to vary on different vehicles,I work in a b/shop and have seen what i consider quite hard front end accidents and the airbag has not deployed..But then a Clio with seat airbags clips a kerb and they go off !..
