Drunk falls

A friend was really drunk and after hot tubing thought she would take a shower. While in the shower she fell down. She broke the soap dish and tore down shower curtain. She did cut her back and then said she wanted to take picture. She said she was going after my home owners insurance to sue me for she cut. She was really drunk can she do this?

If she was drunk at the time the accident occured then she isn't likely to be able to sue,also she would have to prove that your shower was ina condition likely to cause an accident. She was probably just mouthing off though,drunks tend to do that.
Makes me wonder what sort if "friend "she is talking about sueing you for her being drunk and falling in your shower , she should repair the damage shes caused i think!
Being drunk in a hot tub is extremely dangerous for a variety of reasons.

She could have (tenuous) grounds to sue you as the owner of the hot tub if you failed to advise her of this, or encouraged her to be in the tub whilst drunk - and she suffered harm as a direct consequence.

In the scenario you describe - no.

no, it was her own fault entirely, she risked going into your shower whilst under the influence, she is responsible for her own safety, if she does try to sue they will laugh at her.
I agree with the others, but I'd give her a 'bill' for all the damage she caused :)

i have a friend who sued another for a similar 'accident' where she fell and broke arm whilst drunk on mates property and claimed �30K

she won the case as it was ruled that you must take responsibility whilst visitors are on your property. It was a no lose case as courts said that if home owner was drunk they were negligent and if they were sober they were negligent of what was happening to guest

Did she arrive drunk or have the drink at your house as this will have a bearing.

She possibly does have a case .
