Landlord question!

Hi, my friend let her property on a 6 month shorthold tenency. It has turned out that she let to the tennant from hell! The tennant was served notice 9 weeks ago [section 21 or 22 ?] and should have vacated the property on Monday. She is refusing to leave, has caused internal damage to the house, failed to maintain the gardens, failed to inform my friend that she was on benefits and is in rent arrears. What can she do? Please help, my mate was hoping to move back into her 'family home' as her lease on her exsisting property has expired and she herself [and family] will homeless in a matter of three weeks.

Just wanted to also ask.... Does she have rights to enter her property now that the tenancy has now officially finished...... Change the locks maybe ;o] ?????

No, she can't re enter the property unfortunately (even though the tenancy has ended). She can't change the locks either. If the tenant wont leave then she'll have to get a Court Order, it's the only way I'm afraid. If she's issued the s21 then she has started on that process.

If the s21 has been filled out correctly, especially as to the dates, then possession is mandatory once it goes before the judge.

It's a crazy situation that she can't re enter her own house but she'd be the one in Court if she tried to.

Did your friend do a full credit check on this tenant before they moved in?
