if there is a draft of an intensional, declaration of trust tennants in common , and its not been signed or there is no evidence that it exists even with the solicitor, or any mention of it on the land registry transfer documents , will it stand as legally binding ?

Not unless the draft has been signed by both parties and witnessed by two (unrlated to both parties) individuals. An unsigned document is not worth the paper it is written on. Sorry
