Hi,

Isplit with my husband in feb this year. We had a houseto together which is in joint names ....My husband is still living in the house, we have a daughter together which i have topay all child care costa plus rent for us to be able to live....Does any body know where i stand about taking my name of a mortgage as it is stopping my getting a house or any help.my partner refuses to sell.Also how do i go about getting him to pay half of child care as after all she is his child aswell

Phone you local womens refuge (it will be in the telephone book) and ask which solicitor they recommend. Contact her and go and get legal advice. The short answer is you will need to go to court, it will take time and money but in the end you will get your share.

Mr Pippas ex wife managed to get a flat through private let, but paid by the DSS quite easily even though she had a mortgage..

I was in the same situation last year. Why did you and your daughter move out? A court will rule that in the best interests of children they should remain in the family home with their mother. He should be renting somewhere - not you. I strongly advise you get legal help asap. It will not cost you money. Deal with living arrangements first, then tackle chld maintenance. The house is half yours, so he will have no choice than to give you half the value. Good luck. and get advise!!!
A mortgage company will not let you remove your name off the mortgage. You are jointly and severally liable for the responsibilities towards the mortgage as you originally entered into it. Unless you are divorcing your husband and the there are financial proceedings, which include either your husband's solicitors applying to the court for your name to be removed from the mortgage, that is also if he can afford to pay the monthly mortgage payments, which will be assessed, then the mortgage company will not allow your name to be removed. The only way you would be abe to remove it is if you sold the house (agreed between you) and the mortgage was paid off, you split the proceeds after cost of sale etc and you both purchased somewhere else. Regard payments for your daughter, you would definitely need to see a solicitor and consider maintenance proceedings.
