Owed money by EVIL Company

My small company is owed money from another company. At first they responded to our calls saying that they would pay, but eventually began ignoring us. After several months of trying we took them to a small claims court, (which they did not attend). It was ruled that they had to pay the money to us...which they still haven't. The Balliffs have been round several times, but they will not open their door to them. The Balliff is now prepared to give up chasing the money.

Has anyone got any suggestions on how to get this money back. I feel cheated by this company & let down by the law. There must be something that we can do.

The Judge will be along in a minute but I think you can apply to the court for some sort of forcible recovery order, where the bailiffs would then have powers of entry to seize goods to the value of. They would inform the police who would ensure no breach of the peace. There's got to be a way.

this may be a wild idea, but can you take out a charge on their property, so when they come to sell it... you will eventually get your money back. Since there will be a director, and maybe their house is collateral to the business. It's maybe worth an enquiry to a good lawyer to see if creating a charge is worth it.

Can you not go back to court and start winding up proceedings or something to close the company down?
Im sure the courts can advise you on the next step.

There are various enforcement measures you could try - the Court should be able to advise you on them. One (if you have details of their bank account) is what used to be called a garnishee order (now I think a third party order) which is a Court order to take the money from their bank account.

The problem with these enforcement measures is you normally have to pay some more Court fees to get the necessary orders. If they are genuinely insolvent (can't pay as opposed to won't pay) then you could be throwing good money after bad.
