Can anybody help me with this. In brief, i am a fulltime carer for my partner who is mentally ill. I am i reciept of means tested benefits. I have just been left a share in property by my mother who died intestate. My sister still lives in the property and has never left the parental home and is now 62yrs old. My question is do i have to inform dwp now as i know my benefits will stop, or do i only inform them when i have the money from the property sold. My sister does not want to leave can she stay in the property. Does anyone know if the property share i have albeit on paper will be classed as income regarding my benefits. Im worried they will stop them before i actually recieve any monies from property. Any help much app

Make an appointment with the CAB to see a specialist benefit adviser. They will advise the best way to proceed to the best for all concerned. You will probably be able to fully legally keep most if not all of your benefits, as long as the whole thing is arranged correctly. The CAB are really expert at this sort of thing. Talk to them before you do anything else about...

has probate been granted yet? If not then I see no reason to say anything.

My brother is doing the probate for us all, he has just got a letter from probate to take to solicitors as there are no names on property deeds, but i have not idea about probate proceedures so does this mean i actually will own a share, or will this only be when property is sold. Thanx in advance.

yes agree CAB

it would be classed as capital but there are capital restrictions for means tested benefits

oh the answer to when do I own the property is
the day probate is granted

see previous threads - the leading case on your when does title pass question is Queensland Tax commissioners ( CAB can google and read it if necessary )

Thankyou Peter i will pass that on when i get to CAB.
Just to add, get to the CAB as soon as possible. There is normally a waiting list to see the benefits specialists , so the sooner you make an appointment the better.
