Again, help!!!

Ok,

Back in January, we were coming home from my mums, and at a roundabout we were turning left and a women in the the lane next to us to go striaght on then hit the side of our car. We had to have the front wing on the drivers side of our car replaced and had to pay �600 excess fee. She had driven into the side of us (with her teengage daughter in the passenger seat). She then carried on driving so we followed her, flashing our lights a few times and also called the police as she had hit us and driven away.

After 30 minutes she finally pulled up outside her house and Alan got out and she asked what was wrong, he asked if she realised if she had hit us, her reply 'oh was that back at the round about in Stevenage?' He said yes, she apoligised and said that she was tired after driving back from Newcastle.

We have just received a letter through the door saying that she claims we pulled out infront of her so they wat to go 50/50!

Why the f**k, if we pulled out infront of her causing the accident did she not stop? Why did we have to follow her to her house to get the details?

I'm just soooooo ****** off!
If I phone up the local police station tomorrow, am I likely to be able to get hold of a copy of the call we made to them when we were following her?

Hi wiggal if you reported it to the police that this person has hit you and she carried on, surely the police have to investigate this and go round her house and ask her the reason for this failing to stop.And date and time should all be recorded either by your phone call and the investigation for the reason failing to stop.As you say it was your fault do not agree 50/50 ask your insurance company to write to the police who should of investigated this matter.Was there any witnesses?

I phoned the police whilst we were following them, and reported it, but because we followed them and got the details the police were not involved any further.

We were given a reference number which I stored on my phone, but tofday I bought a new phone and have put my sim in the new phone so dont know if we will have the reference details on my old phone.

I was thinking maybe if I call the local station tomorrow and asked if they had a log of the call which was made whilst fllowing the car, in which I said they had hit us and were driving away we could use that as some kind of evidence?

I just dont get that why she would say we caused the accident, yet we reported it and had to go through our insurance and so on!

If you were turning left, then I presume you were in the left lane and she was to your right.

Surely the insurance company could see that there is no logic to her claim that you pulled in front of her.

Or have I pictured this wrong?

Hey Kawa, we will stand our ground! My partner will be phoning the insurance company tomorrow and he wont let it go!

Panic button, the round about had 3 lanes, one is for only going left, theres 2 for straight over, and one of those is to go right, we were in the left lane, to go left, she was in the middle lane to go straight forward, and when she went round the roundabout she drove into the side of us badly damaging the drivers side wing panel.
Im not sure why people blme each over might be to save there no claims,A few years ago i had a accident at night on a country road it was this ladies fault and when i got out to see if she was alright she had already written a letter to say that it was my fault, as it was dark i thought it had her name and address on it.
She asked me to sign it and when i read it in my head lights it said i was totally at fault,i screwed it up and through it back at her. i informed my insurance company and her insurance wanted 50/50.
she said she had eveidence that it was my fault she had forge a make up signature and sketch with me hitting her and told her insurance company that i was not insured which i was ,and she said she had informed the police which i went down to see them and they did not no this women .She ook pictures of a car similar like mine and said she had a wittness. When my insurance company wrote to this wittness she wrote back that she was not there.This women was a nutter, and i told my insurance company if she carries on lets take her to court. it took 14 months to sort her out and the insurance company paid up for the damage done to my car whot a lot of grief.

If it is the roundabout I suspect, between the A602 Broadhall Way and the A1072 Gunnels Wood Road, then the left lane is separated by a hatched area.

That makes her claim even more ridiculous.

If so I would print off an aerial photo from Google maps. Write to the insurance company describing the event, with the photo to illustrate it. Tell them that she failed to stop, despite now claiming you were partly to blame.

I can't see how they could then believe her.

There is an insurance employee who sometimes answers in motoring, though I forget his username. You could always post there for advice.
Hi i work in a car claims dept, basically there's nothing you can do. There's a good chance the other person hadn't intended to dispute liability, but their insurer may have suggested it to them because of the circumstances. When accidents happen on roundabouts liability can be difficult to prove, and the insurer is aways going to act in their own best interests. So your own insurers probably tried everything they could to prove they were liable but were unsuccessful. Your own insurer would not have agreed to a 50/50 unless there was no other choice.
Unfortunately when you have an accident on a roundabout and the cost is relatively low (which is usually the case in claims with no injuries) there's a very good chance of being lumped with a 50/50 !
oh and furthermore, i'm afraid the issue of them not stopping at the scene is considered completely separate and even having that call wouldn't change the liability decision.
