Visa to U.S. (variation!)

Hello,

Slightly different question this time, where the Visa Waiver is definitely not an option: If you apply for a working visa does the U.S. embassy have details of criminal history (as it's located in the same country as the records are held)? Or is it the same case as what has been said on here before, that the UK is prohibited from providing such private information unless a person represents a significant threat?

No doubt someone will correct but if you apply for any type of Visa to the US then they will apply to look at UK records and any sort of conviction then forget it.

'Any sort of conviction' is tripe. Only recent crimes of moral turpitude debar you from a visa (though 'recent' can be up to 15 years ago).

The US Embassy doesn't have details of your criminal record (though I'm pretty certain they could get them if they wanted) - YOU have to supply them with the details in the form of a police search. So they are going to know anyway.

But I assume they'll only ask for a police check if you declare a criminal record at the time of application? If you don't declare then do they assume you're ok like with the visa waiver?
