whats the point

I took my former employer to a employment tribunal as she unfairley sacked me . I won she never bothered to turn up and was awarded �7,000 compensation. how ever she shut the company the next day and has not paid or intends to pay me. i have registed the claim with the county court but they cant do anything as it is greater then �5,000 and she was a ltd company.what can i do as she is laughing at me as she is not paying and says i cant do a thing about it ! this cant be fair whats the point of the tribunal if they cant make her pay?

cant you ask for 5000 instead

no i cant have tried that one and she would not pay anyway too busy going on holidays with the money she owes me
what i mean is if the county court are saying it has to be 5000 then do that instead of 7000
At least she will have a ccj against her
No she wouldn't. That's the point of a ltd company - the risk is only to the company, not the shareholders/owners.

You'll have to forget about this I'm afraid - even if she starts another company the firm you won your case against doesn't exist any more, so you'll not see a penny.

Yes i thought this was the case! still unfair!! i think i will open a ltd company abuse the staff not pay them there wages, then when they complain shut the company and start again under another name. why dont all the companys do this instead of paying out on the compensation they get taken to court for?
Out of interest. What was the business in? not the name of the woman etc.

Did she declare bankruptcy? or did she just close down one business and reopen another? so as not to pay you your compensation.

Are you the first victim of this 'company' and it's unethical free labour?

It was a house cleaning company and yes she did just close the buisness to get out of paying me any compensation she did not go bankrupt or went into liquidation if she had the goverment would have paid me some of the money i was due but because she did not and just finished trading and started trading under another name (same clients same staff etc even same premisis) i cant touch her. she owed me months wages . holiday pay plus the compensation for unfair dismissal. she has done this in the past to another employee but i was unaware of it whilst emplyed by her also i was in her employment for 4 1/2 years she has since i took her to a tribunal sacked another employee and closed the company again
How about a bit of revenge? As this seems to be a habit with this woman a phone call to a reporter on the local newspaper may get the story into the paper and produce lots of bad publicity for this woman and her company.
May not get you your money, but as they say " revenge is sweet"
Of course if you told her first what you intended to do she may cough up, but from what you say I doubt it. Could frighten her current staff into leaving though.
