When it's in the menu system it just turns off by itself, BUT if I quickly open 'shuffle songs' to make it play and strangely doesn't turn off by itself.

ALSO, warranty, I just bought it Feb05, what factors void the warranty?

All sorts of factors can void the warranty of an electrical product like an iPod, but as long as you've looked after it, there's no evidence of major physical trauma to the device and you haven't tampered with it's innards, then the warranty should cover it (though for more specific information, read the warranty that comes with it).

It's well under a year old, so if I were you I'd be getting onto either Apple about it or contacting the retailer from whom your purchased it (since they're responsible for this under European law if I'm not mistaken). You'll want either a free repair or a replacement.
I'd get in touch with Apple, but you should also try the discussion boards on the Apple website (http://discussions.info.apple.com/ - go to the iPod seciton obviously!), there're lots of very helpful people on there who might be able to suggest something less drastic than sending it away or calling an expensive phone line.

PS, remember to search thru existing threads on the Apple site before asking your question! :)

Thanks for the answers, by the way some of my files were downloaded from (how shall I put it) 'grey' sources by the way, is there anyway they could find out and/or will it void my warranty?

I doubt they could know. I doubt they would care, frankly; not enough to get you prosecuted anyway. Not that i'm condoning illegal file sharing, obviously...

Good luck.
