Photoshop CS3. Batch automate help for watermarks

If anyone can help I will be so appreciative.

This is the situation. I have an action to watermark my photos - easy
If I run this action through the automate - batch command all is good so long as my pics are all the same ie all portrait or all landscape. All goes wrong when there is a mix.

There must be an obvious solution that I am missing

Help...please!
