Botanically, a tomato is a fruit: the ovary, together with its seeds, of a flowering plant.

Wouldn't the pepper be described the same way?
I think they are both fruit
You are right Chelle, though I immediately thought of tomato. Perhaps the setter of the crossword didnt realise they both are. I think tomato is probably better known, and it is possible to bite into like a fruit, though you would never do that with a pepper.

Tomato definitely a fruit.
Pepper, whether you mean Capsicum (bell peppers eaten as veg) or peppercorns (ground and sprinkled on food as white or black pepper) are both botanically fruit.
Thanks grasscarp, I as pretty sure they were both fruit, the question really puzzled me!
It would be the same if it said "which is not a vegetable" - then I would have said that a tomato IS a fruit.
So is the crossword answer "neither"?
