Why should he be allowed to stay in this country just because he has had 2 children since he has been here?

/// The hearing was held in Manchester last month where he argued he had a right to stay under provision in the European Human Rights Act for the right to a family life.///

'The right to a family life '

No problem let him, his partner and 2 kids carry on enjoying a family life, not here but in Iraq.

I know, AOG, and it does grate.
But as I suggested only yesterday, the root cause has to be tackled, not the poor old Home Secretary or the UKBA. And the root cause is the interpretation being placed upon the various bits of the Human Rights Act by the judiciary so I suggest you start posting in Judges' Weekly News or barrack the Attorney General about your complaints.
The children will, of course, have Britich citizenship, having been born here. So they can't be exported. Afterall you wouldn't like being exported whilst waving your British passport around, I assume?
It's a well-known ruse amongst those resdiding here and determined to stay - have a kid and your home and dry.

Then he has a choice, go home without the kids.
Good try, but it doesn't work like that.
Ah, back to the old days when Dr Barnardo's would just step in and look after the poor mites.

Military camps are almost by definition and almost invariably in Tory territory. Consequently, whenever it has been suggested that one or other of these might be used for illegal immigrants, a * Nimby outcry - usually led by the local MP - breaks out instantly. So, not totally the fault of "the Powers that be", eh?

If the judiciary didn't bend over backwards to ensure that their judgements complied with the European Human Rights Act there would be less sad incidents like this.
I believe that both French and German judges take a much firmer line when this act is used as a last defence by some foreign miscreant.
If our judges did the same their decisions could be tested in the European Courts. If that court decided that the letter and the spirit of The Human Rights had been breached our judges would be able to say with a clear conscience that they had done their best.
I think they might be surprised how often the European Courts would endorse their views.
I am afraid this is another example of the long slow decline of our country.

The scum of the world come here, commit all sorts of awful acts, then we have a total inability to get rid of them.

Dragging us down to third world levels.
How did he only get 4 months jail in the first place?

Its a well known fact immigrants play on the fact that we would not harm their innocent children.

It was a ruse to just ship there children here on planes so the adults could follow on later.

Its a ruse that children in Charlwood immigration centre need their freedom to grow up normally but once in the community we cannot get shot of them..

If the problem is the length of time before they can be deported then we should fast track them back to the country of origin. This is easily found these days by taking a DNA sample, each country has its own characteristics,
Unfortunately they come without papers so we can't pin down where they originate. For example, Turkish Kurds can claim to be Iraqi Kurds and claim they have a reasonable fear of persecution. Not that simple - sorry. Got to be done via the judiciary being less soft.
As I said DNA have markers to trace your ancestry:
