Following a car accident that even the police are saying was really just an accident - both the passenger and the driver are making claims for whip lash etc. The accusations are really just embelleshed - too fast (i had just pulled away from lights) The driver, who is also claiming stood for over an hour waiting for pick up - no injuries then. Anyway does anyone know what I have todo now - I have just received notification.

Notification that they are taking it through Claims Direct or whomever they are using.
Sorry to hear of your accident. You have an insurance company , let them know pronto what has happened. Tell The other parties who your insurance co is and let the companies fight it out. Admit to nothing. Best of luck.

People will always exagerrate(sp), stay calm about it. You may lose your no claims , unless it is protected, and that is a bummer , but you are not injured or worse dead. As I said the best of luck.
Unfortunately for defendants – fortunately for claimants medical opinion is that soft tissue injuries ,
( commonly referred to as whiplash ) can be caused by a low velocity impact . It is not necessarily the speed of the impact , but rather the movement of the body , especially the neck , that causes injury .

Now , I’m not saying that all low velocity impacts are going to cause ST injuries - it depends on the individual .
There is no doubt that some claimants are lying , when they state that they have suffered injury . They are just working the system .
However it is very difficult – indeed nigh on impossible to prove that someone is lying , if they are claiming whiplash injuries .
Afterall , if I say that my neck hurts – how are you going to prove that it doesn’t .

In high value claims where claimants are suspected of exaggerating injury , it is usual practice for defendants to put the claimant under surveillance .
However in run of the mill cases , this is not cost effective , and compensators just accept that this is the lay of the land
I can't tell from your account ifeveryone thinks (incuding your) it was your fault or not. If it was "really just an accident" surely there must be some fault attached to the other vehicle as well? In which case how is YOUR neck? Painfull all of a sudden?
