executor rights
I have been informed an executor has submited a bill for a hamburger and chips (3.00 approx per time) :-)) fat pig she is too. Traveling she has asked for 3 pounds per mile (she lives over 100 miles away) her parent lives within 2-3 miles of the decesed, her and her parent are beneficiarys . She has claimed for her 8 hours overtime payment on the saturday of the funeral, ie she was there as an executor not a family member, she a beneficiary and a close family member for god sake !! Is there some sort of control in place to stop this, she also claimed her milage on the day of the funeral plus a burger !! she said hello to her parent when she arrived in the area as her parent lives 2 miles away and often visits anyway. lots of items missing from the home. What are the rights of the beneficiary over the executor ? with regards to over charging and going to far etc Has the executor the right to payment as she sees fit. Is there some basic rules the are in force, I dont mean decent rules of love and honour etc she's way past that. Rules to stop someone from over charging etc. Thank you for any advise you may offer.

The executor can only claim reasonable expenses from the estate. (I would suggest 20p per mile is more reasonable than �3 per mile). If she fails to administer the estate correctly, she can be challenged through the probate court. Your first step should be to have an informal chat with the staff of the relevant probate office:

I've always found probate registry staff to be extremely helpful. They should be able to give you some guidance.

When the Legal Bill is submitted to the Law Costs Draftsman - she may get knocked back on her expenses. As a guide - The Legal Aid rate is approx 35p per mile and this is adequate and considered reasonable. A private matter - which is not being funded a by legal aid could be up to .50p per mile - but I've known this knocked back to the 35p rate. She's entitled to lunch and reasonable expenses - she's obviously in it to earn a fast buck. Ask the solicitor dealing with the case to give their opinion.

I asked about some other simple item, the kitchen knife i seen. I thought that must have been in her hands many times. It was personal and worthless. She enjoyed cooking but it was worth very little.

I did get a unframed picture. I asked my parents to ask the
executor (keep it upstanding) for a single pic :-) i have a very nice picture for my family forever and thats all i wanted.

Thi is an interesting question. With regard to the �3.00 per mile you have to ask did she travel the 100 miles by aeroplane using taxi service either end, did she hire a car, was it a taxi that brought her, etc. Normal Government rates of mileage are up to �0.52 per mile for 1500cc and over.
The �3.00 charged for just a hamburger was cheap, she could have charged the estate for a hotel for the night plus all meals. From your email you seem to have a problem with the executor are you also an executor or is the little green eyed monster raising its head?

no i had nothing to gain.
The lady in question also aquired a car with out it going to the highest bidder etc she just said she was having it for x price, when asked to offer it to the highest bidder in she walked out.
You cant tell me that going to the funeral was as an executor and claiming too ! come on it was her friend for 40 years.
As for the green eyed monster all i wanted was a picture, and go it. the other executor is going to see the solicitor about the costs, btw she has charged nothing for her services as its family in her eyes.
