At the moment my son is driving without his tax disc showing - I have it in my bag having bought it this morning - is this legal?

It is an offence to drive a motor vehicle without a current Vehicle Excise Licence.

However as you have paid for a new licence.and it is the DVLA and not the police who prosecute for this offence,it is highly unlikely that any prosecution would occur.

But get it in the car as soon as you can.
The police can and do issue fixed penalty notices for the offence 'failing to display road fund license'.

It is an absolute offence - there are no mitigating circumstances.
