Padiham Rd Burnley Lancs, Nr the Club, Residents cannot get up to their houses because the Council have not gritted, the road is Iced up & dangerous, residents are parking on the main road as there are no available place nearby to park, under the snow & Ice where they park there are UNSEEN YELLOW LINES, the sht at Burnley council has sent traffic wardens out to book the cars, have the car owners got a case if prosecuted? would this stand up in court? the cause of the problem could have been avoided if the council would have gritted the residents road, would you counter claim?

But it's typical,
double check on this ,
but i believe if the yellow lines have warn away " therefore cannot be seen " they may not have to pay parking fines , seem to remeber something about this years ago , however the info could be wrong so do get it checked.

as the yellow lines cannot be seen due to coverage by snow and ice this " may " be a defence against the parking fines.

however as previously stated i would double check this as i do NOT know the preidance for this legally . and the information maybe wrong.

as for a counter claim it would seem councils regarding what we pay our taxes for do seem to be a law unto themselves.
yet again i could be wrong , the best course of action would be to seek legal advice.
IMO the goalposts have been heavily moved in terms of parking ambiguities recently. Funny that should happen in the middle of this recession.

Unfortunately the lines may not be seen but there will be signs on posts above ground if they wanted to be pedantic.

Invovle your local MP. Will soon speed things up
You can always go to your BNP councilors to sort it out.
No excuse, yellow lines are accompanied by signs too, you don't have to see them.
An appeal may succeed. Worth trying.

I appreciate your reply RIGeezer, if you where in the predicament would you be pleased. only low life bloody council would pull a stunt like this, It's a pity they are not as quick to grit the roads & pavements, that is the purpose of paying our taxes.
It does seem quite harsh and might well be worth appealing.

However, on the same token paying council tax doesn't mean that the council will grit right to your front door, especially when you consider that they were running out of the stuff for important things like motorways and A roads.
What does the local paper and the local TV news say about this? Bad publicity has a strangely curative effect !
The short answer is that, by law, yellow lines have to be continuous, unbroken and must end in a 'T-bar'. Any separate signs on posts have nothing to do with it. There are some useful details at

Each case will depend on the evidence available - such as a photograph - which can be tricky as the snow may have melted after you park. Shropshire Council are one of the few who admit that they may have to be flexible:

"Where weather conditions (i.e. snow) have obscured the lines then each case will be looked at individually."

Of course I'd be annoyed but it would never happend because a) I always read the acompanying signs, b) there will also be kerb markings and c) I would also use by boot to clear a bit off to check. Also this is a little bit cute isn' it I mean you know the road near you has restricted parking you didn't just forget because it snowed in my opinion you probably thought, like the others, that it would be allowed because it had snowed for some illogical reason.

For your Information RIGeezer, I managed to get to my workplace so It did not effect me, My ( as you say, thought or Cute) did not come into it, I voiced an opinion , not to get smart @rse answers
