Hello, I have been charged with driving carelessly and without due care and consideration for other road users.

However my only offence was speeding, the police have written in there summary of evidence that I was travelling at an estimated 60mph in a 30 zone.

There was no traffic on the road, I was NOT doing 60mph, I was actually doing 45mph, yes bad I know but it is very easy in a 450bhp Jeep, there is NO speed recording equipment involved and no evidence of that nature,.

The evidence arises solely from the eye witness guess of two cops.

I have got a �2000 a day lawyer on my case, however I am still NOT convinced we are following the correct route, by going for a plea bargain ??

It's a wind-up.
"Driving without due care and attention" is objective and doesn't require proof of what speed you were doing. I'd say the evidence of two police witnesses is sufficient.
I was caught on camera speeding once. I knew I had done it - allowed myself to do 47mph in a 40 mph zone. My three points could have meant I was prohibited from the voluntary driving I did at that time for various disabled groups (for which I had had to pass an advanced test). Fortunately, although I got the points and fine I deserved, the organisers for the vlountary driving took my good record and personal experience of my driving into consideration.
You may be able to keep your licence or you may lose it. The judge will decide, based on the evidence and witness testimony, what he thinks best. If you do lose it, it's not the end of the world. I'm sure you will be able to find a way to work round it.
You already have 6 points - that is surely enough to make you aware that you need to stick to the speed limit as you are so concerned about your business, your employees, your family.

Maybe you need a much smaller, less powerful car and a gadget that makes a loud noise when you break the speed limit.

The Joke of it is !! I now have NO points however on the day I was stopped 6 were still valid, and that is what counts !!!

My lawyer did not ask me to seek a second opinion, I have chosen to seek a second opinion off my own back.

And regards why I was speeding !! Has no one been between meetings, totally preoccupied with work, come on folk this really was just a very quick acceleration to above the speed limit, and when I noticed I instantly slowed down.

And for the last time this is no joke !! What is it with you people ?

Ethel, yes perhaps !! Funnily enough I do have a warning set on my navigation system,but I had the sound off on it typical.

They would have followed you for some distance. Maybe the fact that you didn't see them in your rear view mirror and slowed down was indication of lack of due care and attention.*

Ethel, that's complete nonsense. You know neither of these facts to be true so why on earth would you say that this is the case. The guy is asking for opinions not judgement from ill, advised onlookers. I work with traffic police every day both all over the UK. there are decent ones and nasty sods just like in any walk of life. I don't condone his actions but I aren't going to judge him either.

My case is on Tuesday so I guess I will find out soon enough now, what happens, I shall post up my verdict once I have it, fingers crossed.

B O L L O C K S , B O L L O C K S AND MORE B O L L O C K S !!! by the way road traffic laws are the same in Scotland than anywhere else in the UK , they are legislated by the UK parliament, not Scottish parliament. for it not to be a fixed penalty/points offence you must have done summit for it to be forwarded to court!!

Like I said before...Complete and utter boll0x. If you employ 140 people, and can afford a top-of-the-range jeep, and can afford a lawyer who is ripping you off at �2350 a day, surely you can afford a chauffeur for any length of time you are off the road.

Or am I completely missing the point??

Oh I see your angle !!

Actually the jeep was bought after the sale of my marital home / divorce etc, there is not sufficient profit in the company to hire a driver.

The employee's are mainly part time due to the sector of the industry I am in.

You are tiring some of us slowly. You say you have got 140 odd employees, three children, one wife and an ex-wife to look after. By your actions you have shown gross irresponsibility. If I were you I would plead guilty, which is what you are, employ a chauffeur for the duration of your driving ban, assuming you get one. I would also employ somebody to run your company; somebody you shows more responsibility than you towards your employees.
Give us a break.
IF its not a wind up, which i very much doubt, why didnt you think of your employees and wife and children and ex wife instead of speeding? deserve all you get, obviously no respect for traffic rules or you wouldnt already have points

Hello,

Well thank for all the comments, I kept my License, I got 5 points and a �300 fine, reduced to �200 for pleading early.

So im a very happy man, I have my Jeep being sold on Monday hopefully and im going to drive my Vectra diesel instead, this truely had changed my outlook on driving and I am trying my best to slow down and be a better driver.

My lawyer was fantastic www.roadtrafficlaw.com

Highly recommend them.
