My son was involved in a minor accident 5 months ago. Today I received a cheque from the other car drivers insurance company for the policy excess. Is this right or have they made a mistake. I always thought it was your own insurance that paid the excess. Does this mean the claim was split 50/50. Thanks for any help.

That's right. If you had to pay the excess on the policy when you made the claim, let's say it was 50, then you are 50 out of pocket and the other insurance company are reimbursing you.

If your insurance company have paid you out, they usually knock the policy excess off the amount that they pay you so in that case, they should get the cash from the other company.

It does not mean the claim was split 50/50, in fact as the other company are paying your excess, I would say that they are accepting liability.

Thanks CheekyChops. I thought it was kind of weird as originally the other driver said he was accepting no responsibility even though at the scene of the accident he said it was definately 50/50, his insurance were even going to go to court, but now suddenly they seem to have had a change of heart and are accepting at least some responsibility.
He did not admit liability as most insurance policies instruct you not to admit liability at the scene of an accident (even if it is their fault)
hi
You were lucky,
it took nearly a year to the day for mine to cough up,
but you would have paid excess if your car was repaired
until blame/claim is agreed.

Our car was an N reg and although there wasnt a terrible amount of damage, the insurance said it wouldnt be cost effective to repair it so it was deemed a write-off. Like I said before I wonder why the other insurance company went from saying their driver had no liability and would take my son to court to now saying that it was 50/50, very strange.
