wondered if anyone has ever refused an oscar or if an oscar has been taken back from anyone?

Yes. Dudley Nicholas refused the Oscar for Best Screenplay as long ago as 1935.

George C. Scott refused his nomination for Best Actor in a Supporting Role for The Hustler (1961) then declined the Oscarwhen he won it for Patton (1970): "The (Academy Awards) ceremonies are a two-hour meat parade, a public display with contrived suspense for economic reasons." Hard to argue with that!

Marlon Brando refused to accept the Oscar for Best Actor in a Leading Role (The Godfather, 1972), sending a (fake) Native American up to collect the (deserved) award in his place.

And Woody Allen wasn't there to collect his Oscars for Annie Hall (Best Director, Best Screenplay) and Hannah and Her Sisters (Best Screenplay). He spends Oscar night playing clarinet in a New York pub instead!
