At Crown Court I am being sentenced by a Judge who used to prosecute for the Crown and is a QC, he has been a judge for 1 year.

Wil he be much harder with his sentance due to his background or look to be more understanding as he can now see things from both sides?

Why cant anyone ask anything in the Law section and get a decent answer? It's always just judgement and criticism. It really pees me off.

All judges are not equal...who knows is the answer. There's a saying...different judge...different day...different result.

It is quite unlikely that this Judge has only ever prosecuted. I imagine he will have done a fair amount of defence work too.

Impossible to say how he will sentence though.

I have to say, I have been obviously looking through this site and people ask questions to get intelligent answers from informed people. And some people, well what can I say.
If anyone has an insight into this, I would really appreciate a sensible answer.

Problem is, without knowing the judge, it's really hard to tell.

I a more concerned about the fact the Judge is only 1 year opposed to many years, does this make a difference?

Think about it this way norrin. (I have no experience). Someone who is new to a job often is more conscientious and thoughtful than say a judge who has become set in his ways and getting on in years. Some of the long standing judges might be very set in their ways and not so lenient.

Barmaid I believe has a lot of experience in Courts and has given you an honest answer. It really does depend on the judges rather than the length of time he has been in the job.

Either of your scenarios could be correct.
He could decide to be a 'hang 'em and flog 'em' type to make a mark early on in his career.......or he could decide to be more 'touchy-feely' and hope that you'll be sufficiently contrite to amend your own ways............

there is no knowing how you will be sentenced, apart from within the guidelines.

does your barrister not know of this QC?

No and he has checked in his chambers, my barrister was called 28 years ago.

I would think that the fact that this is a first offence and that you are a carer for two elderly parents would be taken into consideration. (If it is a fair world - I have now read through what happened)

Norrin, it really is impossible to say. JacktheHat and LoftyLottie have both explained that he could go either way.

He will probably have had 20 years' + experience of these matters so will be fully familiar with tariffs and sentencing principles. Not only that, he will have had Judicial training.

The best thing to do is ask your barrister when you meet him as to how this Judge sentences.
