hi there

really need some advice,, friend had an altercation last yr with a member of staff (both recieved final written warnings) since then this member of staff and his friend have been giving constant hassle and making his work life hell.. He has brought to managers attention but nothing done. (since this incident he kept a diary with all incidents and dates etc and one of the colleage committed several counts of gross misconduct but never apprehended)

any way 2 wks ago this guy made defamatory remarks about my friend then threw an object at him, they then started arguing and attacked him,, my friend then fought back in self defence and came out of the fight better.. now the guy is trying to prosecute (trying to get compensation prob)... they were both suspended on full pay and have both had 1st meeting and 2nd scheduled for next week,

alot of dodgy stuff is happening in work tho.. the other guy was caught on premises having private chat with manager (not allowed near premises when suspended)... all other members of staff side with my friend and gave statements voicing there feelings on this other guy and the manager said it was irrelevant?? is this allowed, he was basically telling them what they could and couldnt say.. also police came into work and again manager told them just to say what happened and nothing about this guys ,, therefor influincing people..

sorry for long post,, guess my question is does he have leg to stand on,, hes been harassed (management ignored and lets this person away with everything)

Sure cannot be 'anywhere near work' .. or not in the workplace (which is different)?

Seems like the Manager needs reporting to me.
See how it goes and sue for wrongful dismissal. Secure witness statements asap, just in case......and for use in the meeting. The manager will have to have more than just him/her present.....
Tell your mate to get advice from his union or acas asap
