If it's your garage, he can't. Is it?
Do you mean he as erected a roof over walkway next to your garage and the roof is affixed to your garage?
Question Author
yes
If he fitted it without your permission and you dont like it tell him to get it unfixed or you will, unless of cause for some reason you've not mentioned he has some rights permitting him to do so
agreed with paddy. My neighbour was having an extension built and he planned to sit the roof on my boundary wall (so the rain would run off into my garden in effect!) - my solicitor said he had no right to do that, and they had to redesign the roof.
Question Author
what if our neighbour wont take it down,
It depends on the relationship with your neighbour. He must listen to reason
Question Author
we do not speak to this neighbour, since they have become older
Question Author
our neighbours have become funny towards us
This is one time you will have to speak to them, before more work goes ahead. Not very neighbourly if you live next door, what's the matter that you don't speak?
Question Author
they just stopped talking to us, and being very funny towards us, reasons we do not know, however we feel they are envey because of the work we have had done to our home, and it has made theres look shabby
Been thinking about your problem, do you have any problems with the neighbour or even the roof over the walkway other then that he didn't ask your permission to fix it to your garage? It's always nice to try and sort this sort of thing without to much unpleasantness after all you may be living next to them for many years to come so I would suggest the first thing to try is just have a talk to them before resorting to any thing to heavy, even though as I said in my first post if you don't like it it's got to come down
Paddy, look at this adjacent post too, it's gone a lot further than that, there is a furnished room in there now! http://www.theanswerb...w/Question907900.html
Question Author
our neighour is trying to sell his home with this utility room joined on to our garage, hugh mistake we think, or not
sorry didn't refresh before posting so didn't realise you were having troubles with the neighbours
I would assume that the garage is totally on your land so the footings will be as well.....by attaching to your garage wall he is also pinching some of your land......
By the sound of it the time to get in touch with your soliciter has come, it seems to me your neighbour is being totally unreasonable in his actions. Have you been in touch with your local council and checked if he's got any permission for this work he's having done, the fact that you've not recieved anything asking if you have any objection to the work would point to the fact that he has not applied which could lead to action been taken against him from that side
Quite right paddy......my brother's a building inspector and he'd have it demolished in no time.....
Question Author
thank you for all of your answers to our problem, we now know that our neighbour is in the wrong, what would we have done without all of your help, again thanks
Go to a solicitor - if your neighbour is selling the house there will be land searches done, you need to be clear what's yours and what is not.
