This question is so wide and of such a large scope that it takes up whole entire books and 32 page articles in the Cambridge Law Review. Try reading about the Hart v. Devlin (Prof. v. Lord) and some J.S Mill. If this is for an assignment for a deadline soon, I'd start right now.
