The affray got dropped but my partner got found guilty for one abh, its his first offence and and the man had brusing, my partners brother in law got abh for both men which one got a broken nose, my partner is not getting done for the man with a broken nose. Nice of him to completely ruin the wedding memories of so many people. I hope he gets locked up until he learns to keep his fists to himself.

I dont think you understand my question we were the ones that got started on!
Now that mamjet is feeling a self-righteous glow at your expense I'll try and answer the question for you!

The magistrates guidelines for ABH for a first time offender pleading guilty is a custodial sentence. But the quoted mitigating factors are :minor injury, provocation, single blow etc. all of which seem to apply to this case.

If these are stressed and the court see the events in a similar way to how you describe them I'd be surprised if he received a custodial sentence.

I am a bit surprised that he was charged with ABH if the other guy only had bruising - I guess it must have been bad

He went for self defence but got found guilty, is this worse!
No, no, that'll count as a good thing ... WHAT THE **** DO YOU THINK???
i pretty sure he will not go to prison...at worst maybe a suspended sentence.
Question Author
Dont be a sarcastic ****, I no its not gunna be good, i just want to no if he is lookin at prison, but your answers so far have been crap! so i sugest u TRY and help someone else!!
Question Author
Thank you Nhozu, my last reply was to mamjet!
The men who started it took them to court?

Where there witnesses? were the police called?etc etc

Surely your partner had a solicitor who could advise you better than us dimwits lol
*adding to my last...*assuming he doesn't have a criminal history...
Yes, he is looking at prison. Tell him not to pick up the soap in the showers or he'll come out walking like John Wayne.
Question Author
No its his first offence!
Question Author
Your actually quite sad mamjet!!
Lock the ****** up until he's learnt his lesson. Next question.
It doesn't sound as if your partner was well advised!

Self defense is tough at the best of times and you've said yourself that he went over to help/stop it so he could hardly claim he had no other option but to fight!

He'd have been better pleading guilty to common assault - did nobody try to get the charge reduced?

Well it's a bit late now - he should be OK providing the magistrates don't think he's likely to be a danger to the general public
Question Author
Well if you dont like my question then **** off, Im glad your not my mate cos to me you cant read properly, my partner was tryin to stop the fight!!
Question Author
Thank u jake the peg at least someone has something decent to say!
if its his first offence probably not, he must explain to magistates the situation etc and plead for them to understand what has happened.

In answer to your question yes they do have the power to send him to prison, magistrates i think can only serve a custodial sentance for 3months max

ias long as he can prove to magistrates he is of good character and this was a mistake to help family he could get off with a conditional discharge

if he plays his cards right
Yes, trying to stop a fight by committing ABH is always a good plan. your partner sounds like quite a catch. Prisons gain will be the university's and colleges of the UK's loss.
mamjet,

you obviously live in a box with no contact with the outside world,

wake up sometimes you gotta do what you gotta do

and then all you gotta do is work out how to get away with it

ask politicians.........................

they all do it!
