Can a company advertise a vacancy (on an external website, that does not resrict it's users) and then state that the post is open only to internal employees? How would they stand legally?

'Ring fencing' a post is a common, and perfectly legal, practice.

For example, many local authorities have websites where they advertise their vacancies. The websites are public but you'll frequently find jobs advertised which are only open to current employees of the authority. (This is usually because they're seeking to re-organise their work force while avoiding redundancies. For example, a council which is closing down some schools might 'ring fence' posts in similar schools to help the staff from the closing schools find new employment within the authority).
