my brother had his hearing today at the police station today. he has been charged with harressment 2.12 to his ex girfriend - evedence was text messages.

He has been given a date to appear in magistrates court on the 26th oct - his solictor said it is imprisonable charge - he has never been in any trouble before, first time offender, she said its better it goes to crown court but he is pleading guilty what is his sentence - i gather it may be community service but is prisonable.please help

If he did it, he needs to admit it but he also needs to show remorse and understand what it must have been like for his ex-g/f. Since he's a first time offender, and if he shows regret for the aggravation and hurt he has caused, the magistrate may be lenient and let him off a custodial sentence with community service. But make sure he is truly truly sorry - it has to look genuine. That would probably go best for him. Then he has to move on and not think of her any more. Otherwise he could be back before the court and face prison the next time.

To be honest constant repeat offenders aren't getting jailed so getting jailed for harrassment by text???

i am not sure but I think he called her names and swore and he said things likfe I hope you die bitch and stuff... you know the knid of things people say when they break up and one persons cheats while in a relationship. I guess prety bad then.

he was charges unders section2.1.2 does this mean he has to go to prison
You need someone like Ethel to answer as Im not up on the law, it just seems very strange to me that it has got this far with just "test messages".

I know it seems strange to me as well. and yes I agree some of the messages I have sent to guys god!! got to be carefull
Ive had death threats by phone, but you know its just because the other person is upset so you ignore it, but to get charged and go to court?

Still doesn't add up to me, when repeat offenders don't get jailed.
