After nearly a 2 year fight with an ex over him trying to claim an interest on my property. I have been waiting for a hearing date and found out today that it is set for March 08. I honestly thought it would of been earlier than that. Any opinions?? Thanks

My goodness, what are the details...I ahve just gone through the exact same thing only yesterday, with a terrible out come...I brought a home 6 years ago, and when me and my ex, who is also the father of my daughter moved in, I stupidly put him on the deeds. Granted whilst he lived there he went half with me on everything, and by the time he left, the property had increased by about 16k? I tried to buy him out, to remove him from the deeds, but he was having none of it....yesterday came the day I ahve been waiting nearly 4 years for. The house has gone up another 100k!!! he has not paid a single penny since he left, for anything...and he got awarded half, and I have to sell, I ahve his 4 year old too...I'm just devestated beyond belief. PLease please, make sure you do lot's of re-search and get a really good solicitor...a really good one, mine was crap.
what is your situation???

Hi Mantha
Gosh why did it take 4 years. Did you go through the Land Registry. Were you the applicant or the respondant. Was he your ex partner or husband? Sorry for all questions but our cases are similar. The only advantage I have is that he sold the house to me. It was all transfered legally by my solicitor, and the only stipulation of the transfer was that I redemmed him of his mortgage, which I did.
What he is now trying to do is say that I promised him some money (which I did not) he has no evidence of me everysaying that I would give him some money. When I bought the property from him he gave me a letter for my building society saying that he was selling it me for x. And that is what I paid him. But he is now saying that he did not sign this letter, and that he will get it analysed if I dont agreee that I forged it. I have told him time and again (and his legal rep) to get it analysed but he never has. So I am now going to get it analysed myself so I can produce it at the hearing (hopefully this will help my case). So luckily he is not on the deed I am the sole owner.
I am really sorry that it did not go in your favour, id of thought that when your ex had moved out then he would only of got a % of the value of the property at the time he left.
I am so worried that when it goes to the hearing he will keep trying to get it adjourned, I just hope mine doesnt take 4 years to resolve.
Look on the bright side Mantha at least you are free of him now, move on and enjoy life. I know I will once I can get rid of this parasite.
