if a seller says they have proof of postage / tracking number but even after over two weeks the items hasn't arrived and the seller continually refuses to pass on the tracking number to the buyer is this illegal to with hold the tracking / proof of postage

Is this eBay?
If so just report the seller to eBay customer service. They will immediately remove the disputed payment from the sellers account and put it on 'hold' until the dispute is settled.
Or, in other words, the seller has not sent the item or why else refuse to give you the tracking details?? They are there for your use, as well as theirs. I would demand my money back!!
...and it would help if OP confirmed if this is eBay or not.
