I've been talking to this guy for three years am just recent started seeing him an he's now just told me that he wants to be with me but he might be getting charged with Statutory Rape an I'm getting my self all worried thinking I might see him again.

So my question is how long can you get for it and if someone could help me understand what Statutory Rape is?

http://legal-dictionary.thefreedictionary.com/Statutory+Rape n statutory rape, overt force or threat is usually not present. Statutory rape laws presume coercion, because a minor or mentally handicapped adult is legally incapable of giving consent to the act.

It's unexplaineable as to why I want to
Nothing new or helpful to add, but I think the answer from jackthehat @ 10.32 is spot on.

What will be will be, let this get settled then think carefully about the future.

I am!
Quick question if it doesn't got to trial can he still get a sentence?
No.
It seems he has been to trial as you say he's been back and forwards to the courts.

Okay an he's has been to trail he's at court today an they said it's not going to trail an he's got to go back at 2 to see what he's getting
Keely,I think you need to talk to a trusted adult face to face about your relationship with this man (yes he's a man regardless of his 'mental' age).
You'll soon know then - big decisions ahead.

Take care.
Do you mean because he's pleaded guilty he is going to be sentenced today?
Question Author
I have spoken to my mum about it
Question Author
Yeah but it's not going to trail
I may be wrong, I have no experience in this but just because someone was deemed with the mental age of 8 when 13 does not mean that 5 year difference maintains through their life so he's not necessarily 14 now and he won't have the mental age of fully developed 30 year old when he's 35.
I would he assume he will always be of childlike mentality.
What do those in the know think?
If he's pleaded guilty its obviously not going to trial is it?
I don't think there is a yardstick Prudie - each case will be different depending on what caused the lack of mental acuity when he was younger.
No, it won't go to a full trial if he has pleaded guilty. A trial is to determine facts when the defendant pleads not guilty.

He is attending the sentencing hearing where the judge will tell him what the sentence is. This could be an absolute discharge where he is given no sentence at all; community service type punishment; a prison sentence or something else. He may have to sign the Sex Offenders' Registers for a set period of time
Question Author
So he can still go to prison depending on the judge as he's got the procurer on he's side
Procurer?
Procurator fiscal maybe??

Scotland?
Well it would be the prosecutor fiscal who charged him in the first place if he is in Scotland, so he's hardly on this young man's side
I'm wrong then.
