This is the document that the courts use when determining sentence:
http://sentencingcouncil.judiciary.gov.uk/docs/Assault_definitive_guideline_-_Crown_Court.pdf
Since you've not told us what you've been charged with ('Common Assault'? 'ABH'?, 'GBH') I can't direct you to the relevant section. However, based upon what you've written, I can't see that a prison sentence is likely. An unpaid work order (perhaps coupled with a requirement to attend an anger management course) would seem to be far more likely.
It must be at least ABH, Chris if we are talking Crown.
I agree Barmaid (although, under Section 40 of the Criminal Justice Act 1988, 'Common Assault' can be included on an indictment) but I was confused by the information in the original post which did not appear to meet with the requirement for 'serious injury' for a charge of ABH to be sustained.
I believe from other posts on similar topics that whether or not your wife retracted her statement, the case will still go ahead - the prosecution may be concerned that you pressured her into doing it.
Addendum:
. . . So it's possible that the poster's counsel might advise him to ask the court to accept a guilty plea to the lesser charge (which can then be dealt with by the Crown Court but with the Court's sentencing powers limited to those of a Magistrates Court).

As my wife retracted her statment, what will happen in the crown cout if she not talk and not answer their qustion
Have you got a solicitor yet, hussain? They will be able to answer your question. Not answering questions in court may be deemed as contempt of court, I believe.
The Court may suspect that your wife is so frightened of you that she refuses to give evidence. They will use her statement and other evidence

I have a soliciter but not trust them , they trying to make the matter longer to make more money, bythe way I am not alowded to see my wife. I did not know about her retractin , a friend told . I am happy with cuminity order or fine but not fare if I get custady . Are the jury nice poepol or they just confirm whatewer judge saying? I never been to any court in my life .
Question Author
I realy love my family . I have nothing to frightened off . I am a family person .
We can guess that you've never been to court. The jury are chosen at random; there is no way you can say that a jury is nice or not nice. It is twelve people who are all different.

Do you what your lawyers advise. They can't be making much money out of your case and making in longer is of no benefit to them whatsoever, whatever nonsense you've been told.

If you think that the case against you will not go on because your wife wants to retract her statement or say nothing, you may be in for one of the biggest shocks of your life.
Is this your wife, faisal? Big coincidence if not! http://www.theanswerbank.co.uk/Law/Question1307244.html
you do not get prison. you get to go to counselling and you get to be a real husband and make up for what you did by telling the world you did it and accepting responsibility for your actions. Lying is stupid and does not show you love your wife at all.
I can tell this is a wind up, If its not then I apologise
Perhaps better to say nothing then, pravstar
