This is just getting stupid now and I suspect who ever it was that said this person will prolong the dispute until it is past the 45 days was correct.

You HAVE to go by ebay's rules on this nothing else will work
1, open a dispute with ebay for 'not as described' when the case is open describe the fault and ask to return the item for a full refund.
2 return the item by international signed for postage with Royal Mail (not Parcel force) it will cost £12.50 to do this but unless you do then the seller can just ignore you or mess you about as they are doing.
3 once it is returned and you have the proof of delivery the seller has to refund the price and your costs.
As soon as the dispute is open ebay/paypal remove the amount involved from the sellers paypal account and put it on hold. If the seller does not do the refund then ebay / paypal will give you the cash back from the 'held' funds.
No good worrying about sale of goods act or anything else the sale was via ebay and unless you do it by ebay rules you will get nowhere.
If you have not opened the dispute do it NOW so that ebay will contact the seller and put the funds on hold.

I had a similar problem recently with an Ebay seller. I had bought a £430 laptop and when it arrived it was broken. I tried contacting the seller and was ignored.
I opened a case almost immediately (because of the high value) and the seller was livid with me going by the tone of the email he finally sent me (he wanted to sort it out without Ebay involvement he said). I was eventually given an address to return the laptop to at my own cost (courier- £28.00), as soon as the seller received the laptop I was refunded the purchase price but not the postage.

All this ebay lark is a bloody minefield isn't it, it's not the buyers fault yet they're out of pocket!

I understand what needs to be done Eddie, I'm just mightily peed off to say the least that I will more than likely lose the return postage.

I bought an item of jewellery last year and when it arrived it was not like the picture and not what looked like the genuine item as I knew what that should have been ,I opened a case because the seller insisted that it was correct but I knew it was not and when Ebay became involved they told me to send it back and sent me a prepaid label to download for posting and receipt,I got all of my money back as soon as I confirmed it had been posted with the tracking number,I don,t know if it would make any difference if your case is Hongkong,mine was about £100 and a UK address
You probably wont want to hear this but I googled the site you mentioned in your previous post and there are quite a few similar complaints. I have yet to find anyone who has successfully received a refund. They have just been stalled until the dispute period expires. Do you really want to spend even more money on postage returning the dress, obviously this is your call. A lot of the replies to your post offer sound advice relevant IF this was a legitimate Ebay trader but from what I have read it is just a scam with fake pictures on their website and shoddy goods supplied.

Oh you're totally in the right Pauln, personally I would not have touched them with a barge pole, but my daughter insisted :0/ Her loss!

You are making a mistake by communication via email. ONLY use ebay messages that way ebay can see everything that has happened, they can read all ebay messages but not emails. You would have proved your case by now if this had been on ebay messages.
