can someone be charged with sec 20 assualt when there is no evidence of assualt

my brother was original charged on sec 18 for an alledged kick the evidence proves my brother did not kick anybody but is being charged now for sec 20 cos he was there with the person who punched somebody, he is being charged for the same thing but all the evidence says my brother didnt assault anybody, can u be charged with causing gbh if you were just stood there.
