Common assault 3rd time

An ex partner of my daughter attacked her in March this year He has been found guilty of common assault and is awaiting sentence but after the case the magistrates were informed he has been convicted of common assault before in 1993 and 2006( wasn't given the outcome of the previous offences) how will this affect the sentence. They ran out of time during the case but gave the impression it would only be community service. Many Thanks

The 1993 offence will not be considered at all as it is long since �spent�. The 2006 offence will count against the defendant. The court will not hear details of that offence, only that a conviction was recorded and the sentence imposed.

Common Assault rarely results in a custodial sentence. In fact, most offences result in a fine being imposed. A community order is considered if the offence involves one aggravating feature, whilst custody is usually not considered unless two or more aggravating features were evident.
