My partner was found guilty by a jury of the above charge. The trial was in his favour, there was no forensic evidence and the police hadn't even bothered to send off a sample of his blood or his clothing. He was attacked with a knife so he hit the guy with a piece of wood. The medical report states that the injury (a fractured skull) was consistent with a single severe blow to the head with a blunt instrument. Obviously he claims self defence but the jury still found him guilty. What sort of sentance could he get and what can a recorder judge give?

i don't know whether he has been sentenced yet, but most probably. My son was found guilty of section 47 under the same sort of circumstances and was sentenced to 30 months. The police said in court that they could not be bothered sending the blood stained clothes off for forensic evidence because it cost too much money and there were no witnesses. Just this lad saying that my son had done this to him. The jury found him guilty - it was an utter farce. He was sentenced by a recorder - they can give the same sentence as a judge. Hope all went well for you - it didn;t for us.
At least he is alive that's all that matters! Better to be judged by 12 than to be carried by 6. I wish him all the best!
