my son charged with gbh s 18, he heard screaming and banging upstairs (we live in a block of flats)he went to see what was happening, grabbed a hammer on the way,he thought someone was being attacked as it was a girl screaming when he got there found man who lives in the flat with his girlfriend banging on door the girlfriend was inside my son offered assistance and the man attacked him he accidently hit the man on the head with the hammer causing a cut which needed one staple,he also hit him delibratly on the leg with the hammer this was to stop the man kicking him down the stairs,after the fight was over my son called ambulance and police he is going to trail as he said he did not mean to harm anyone and that he only used the hammer in self defence the couple were having a domestic disbute at the time what are the chances of him being found guilty son is disabled blind in one eye never been in trouble before

how do you accidentally hit someone on the head with a hammer?

the man went to hit him he was on stair landing, my son was on stairs he put his hand up to protect his face unfortunatly as he put his hand up he caught man on head with the hammer
Unfortunately, it's the other man who has the injury. It's probable his girlfriend will back his version when the case gets to court.

girlfriend was stuck in house she could not get out man had damaged door frame so the door was stuck police had to break door down to get her out
Blind in one eye is not disabled. You can still drive a car with only one eye. I know, my daughter is blind in one eye.

As for the rest....I don't think he'll be able to claim he 'accidentally' hit someone.

took hammer because he did not know how many people were there or what was happening did not know if girl was being attacked or raped

hammer was near front door I had left it there earlier as i had been putting pictures up in passage

Thank you Jack the hat and redhelen I have not had any dealings with the police or courts so am at a loss dont know what to ask barrister.
