Do you mean fair in employment law?! Or fair in its employment?
As far as employment law is concerned, I don't really know (will not touch employment with a barge pole). However, as far as the decision goes in relation to Housing Law (and I have successfully applied it to education law where disability discrimination was claimed), yes I see it as fair. Have you read the full judgement? It is actually quite insightful.
