In a divorce petition with a 2 yr separation -is the 2 yr separation from date of marriage OR is it taken from date of petition - (im sure it is from date of marriage)
I ask because court has incorrectly? retuned a friend's self filled form stating "not 2 years"

it's 2 years from the date of separation.
it is assumned that a seperation agreement would have been drawn up....so is from the date that the seperation was legally put in place.

My friend married in 2003- and separated in 2007 - so thats above the 2 years?
I'm actually still none the wiser
We've only just started 2009 - it is 2 years minimum since they separated. What date did they split up?
i was married in 1997 and separated legally in 2003. my divorce came through in 2005.
you need to have been seperated for 2 years, as others have stated. What date in 2007 did they seperate? It's 2 years from that

It was jan 07 -so now i understand why it failed 2 yr rule- but it(if my understanding is correct) seems daft- as an example a couple could be married , say , in 1990 and separate in 1993 - but would fail 2 yr rule if they applied for divorce in jan/feb 2009 -and yet they have been separate for 16 years!
As has been stated, the couple have to have been separated for 2 years for a divorce to be granted on those grounds so the last example you stated would not be a problem either - they have been separated for more than 2 years
tali, you've got it wrong! if a couple can prove they've lived apart for 2 years, and both parties agree to the divorce, it should be granted.
i got divorced after a 2 year seperation. I just had to prove it by showing Id lived apart from him for the 2 years.
tali, you seem to be confusing a very simple situation - in your example, a couple who seperarted in 1993 could apply for a divorce from 1995 onwards (after two years of seperation had passed)
