I have a friend who works in a hospital, recently took a hepatitis C test, and result initially came back positive. To cut a long story short, the test was flawed and after many other detailed and more specific tests, the result has since then continued to be negative.

The private hospital where he works is creating a fuss over it and he has not been allowed back to work just yet. He is getting paid in the meantime but he's frustrated as he is impatient to get back. He was told by someone that unless he is terminated he can't file a lawsuit against the management.............is there anything he can do to push them for an ultimatum?

Turn the tables here. Imagine you're a patient's partner or parent, and you find out that an employee of the hospital just may be infectious. Not guaranteed, but definitely came up positive at least once. How would you feel? Would you be inclined to hit the hospital with a lawsuit?

Or scenario two - for some reason there's a string of false NEGATIVES, and your friend is infectious and causes someone else to get ill. And he's working in your hospital. What would you do?

In cases like this, there can be no excuse for being anything less than 100% careful, and there will be an inquiry into how one or other set of results was false. Your friend will not be allowed back until the facts are found, and this may mean him enjoying some free paid leave.

That's the thing, its been months since they started investigating. His blood tests have been sent to France, Germany even the States. They were all negative. Its the people in the lab who tested my friend initially who are in trouble, as they may lose their jobs over this and my friend thinks that they are the ones delaying the case and making things difficult for him... so nothing's certain for now.

He is thinking of hiring a lawyer to get a second opinion, but I just wondered is it even worth it? Would a lawyer be able to give any useful advice or information that he doesnt already know?
Doubtful. He should just enjoy his paid leave and let them get on with it.
