I sold an item on ebay and the buyer has recieved it damaged. It was well wrapped and also postal insurance was offered on the listing, which the buyer opted out of.

It was sent via standard parcels, in which case, she can't put a claim in with Royal Mail, but again this was stated in the listing.

Due to it being well wrapped and her opting out of insurance, am i liable to give her a full refund as this is what she is requesting..

The way i see it is, i sent the item well packaged and its not my fault that it was damaged. I did state on my listing that once it was sent to the post office, it wasn't my responsibilty.

I have also posted this in Chatterbank :-)

Many sellers appear to be under the misapprehension that it is the buyer's problem if they don't receive the item in good condition, or don't receive it at all.

It is in fact the seller's responsibility, and the seller's choice whether they decide to opt for insurance.

From eBay's Help pages:

"Postal Insurance
It is the sellers responsibility to ensure that the item reaches the buyer, so its down to you as the seller to decide if you want to insure an item being sent, not a choice for the buyer to make. If it is lost enroute, *you* are responsible for replacing the item, or refunding the buyer."
I recently received a damaged parcel which had a note from the post office about claiming compensation. I contacted the seller who immediately sent me out another item and asked me to return the letter and item to them which I did for them to seek compensation.
Yes I'm afraid you'll have to give a full refund including postage.

Someone tried to sting me like this (pretended not to have received the item) but backed down after I questioned him, and since then i always send recorded delivery so that I can prove they received it
was it something that could have easily broken or not
