long story.

cut short...

my car was parked in a roadside parking bay. a vehicle leaving a car park scraped the offside corner of my car. the damage was mimimal to both vehicles. my car was standing still, ignition OFF !
my wife was in the car at the time of the incident and swapped details with the other driver. as required by law i believe.

3 weeks later we get a call from the son of the other vehicle telling us he had been to his insurance and was claiming off us for the damage to his mothers car.
(they are saying we reversed into them !)

there were no witnesses and no real damage to either car.

WHERE DO I STAND REGARDING THE LAW ??
we are working with our own insurance company to resolve the situation but it looks like we will loose without an independant witness !!

to say im not happy is an under statment !

well its your words against his! if they want to take it further then so b it.... but doubt he will win,
Perhaps you could conjure up a couple of witnesses ?
Very odd. Insurers usually operate knock for knock in such situations. The very worst that should happen is that your damage would be paid for by your policy.
yeh, if no one owns up then it ends up your own insurance company paying for your own damages. u should contact your insurance co. asap and let them know the situation and they will b very happy to help u. they will put notes on your policy but wont put anything forward til the third party writes to u.! they will help u win the case.
